Kiyolu Terms of Use

These Terms of Use ("Terms") apply to the Kiyolu app for iPhone and iPad, including earlier versions published as "Lumina", and to its widgets, Siri and Shortcuts actions and Control Center controls (together, "the App"). The App is provided by Yagiz Ada Umur ("we", "us"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

1. Not medical, psychological or financial advice

The App offers affirmations, quotes, mood check-ins, a gratitude journal, breathing exercises and background sounds for general wellbeing and inspiration. It is not therapy and it is not a medical device. It does not provide medical, psychological or other professional advice, diagnosis or treatment. This includes content about anxiety, sleep, fitness and health, pregnancy and motherhood, and heartbreak. Always talk to a qualified professional about your health, and do not ignore or delay professional advice because of something you read in the App.

If you are in crisis or thinking about harming yourself or someone else, contact your local emergency number or a crisis line immediately.

Breathing exercises: stop if you feel dizzy, light-headed or uncomfortable. Do not use them while driving, or in any situation where losing focus could be dangerous. If you are pregnant or have a heart, lung or other medical condition, ask your doctor first.

Content about wealth, money and success is motivational only. It is not financial, investment, legal or tax advice. Spiritual content draws on many traditions and is offered for reflection; it is not religious instruction and does not represent any religion or organisation.

Mood check-ins, streaks and Lumi only reflect how you use the App. They are not a measure of your health.

2. Who can use the App

If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian, who must agree to these Terms and is responsible for any purchases.

3. Your licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including Family Sharing where Apple allows it.

Your licence is also governed by Apple's Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, unless we provide a custom licence agreement on the App Store. If these Terms and that agreement conflict about the licence, that agreement applies to the extent of the conflict.

4. Kiyolu Premium

Kiyolu Premium (called "Lumina Premium" in earlier versions) is optional. It unlocks the features marked as Premium in the App. These currently include all premium categories, writing your own affirmations, photo backgrounds and premium fonts in the Theme Creator, and choosing the category and theme of your widgets. The features included, and the plans and prices available to you, are shown in the App before you buy, in your local currency.

Kiyolu Premium may be offered as an auto-renewing subscription, as a one-time purchase, or both.

Auto-renewing subscriptions (for example, monthly or yearly):

• Payment: payment is charged to your Apple Account when you confirm the purchase.
• Renewal: the subscription renews automatically for the same period, at the price then in effect, unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Free trial: some plans may include a free trial for eligible users. The length of the trial and the price that applies after it are shown before you confirm. If you do not cancel at least 24 hours before the trial ends, it automatically becomes a paid subscription. Any unused part of a free trial ends when you buy a subscription.
• Managing and cancelling: you can manage or cancel your subscription in your device's Settings under your name > Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you have already paid for. Deleting the App does not cancel your subscription.
• Price changes: Apple will notify you of a price change and, where required, ask for your consent before a price increase applies to you.

One-time purchase ("Lifetime"):

• You pay once, and the purchase does not renew.
• "Lifetime" means for as long as we offer the App and Kiyolu Premium on the App Store and the App supports your device. It does not mean the lifetime of a person.
• The purchase is linked to your Apple Account. You can restore it on your other devices signed in to the same Apple Account with "Restore Purchases".
• Buying the one-time purchase does not cancel an existing subscription. If you have a subscription, cancel it yourself in Settings to avoid further charges.

Restoring purchases: if you reinstall the App or use a new device, tap "Restore Purchases" in the App.

Refunds and withdrawal: purchases are sold by Apple and are governed by the Apple Media Services Terms and Conditions. We cannot issue refunds ourselves. You can request a refund from Apple at https://reportaproblem.apple.com. Any statutory right of withdrawal you have as a consumer, for example in the EU, the UK or Türkiye, is handled by Apple under the applicable law. If Apple refunds a purchase, Premium may be removed.

Changes to Premium: we may add, change or remove features and content over time, to improve the App or for legal or technical reasons. This does not affect your mandatory consumer rights.

5. Your content

Custom affirmations, journal entries, mood check-ins, themes and photos you add belong to you and stay on your device. You are responsible for the content you create and share, and you must not share content that infringes anyone else's rights. We do not back up your content. To the extent permitted by law, we are not responsible if your content is lost because you delete the App, lose or reset your device, or do not keep a backup.

6. Acceptable use

You agree not to copy, modify, distribute, sell or rent the App; not to reverse engineer it or try to extract its source code, except where the law allows it; not to bypass or interfere with purchases or other protections; and not to use the App for any unlawful purpose.

7. Quotes and attributions

The affirmations in the App are written by us. The App also includes short quotations from writers, thinkers and public figures, and traditional proverbs, shown with the name of the person they are commonly attributed to, for inspiration.

• Attributions are given in good faith, based on widely cited sources. Some may be inaccurate or disputed.
• A quotation or a name in the App does not mean that the person, their estate or their publisher endorses, sponsors or is affiliated with the App.
• Quoted works remain the property of their respective rights holders.

Notices: if you own rights in content shown in the App, or represent a person named in it, and you believe it is used incorrectly or without permission, email us with:
(1) your name and contact details;
(2) the quotation and where it appears, for example the language and category, or a screenshot;
(3) the right you hold or the person you represent; and
(4) what you would like us to do.
We will review your notice promptly and, where appropriate, correct or remove the content.

8. Intellectual property

The App, including its design, code, the Kiyolu name and logo, the Lumi character, artwork and our original affirmations and texts, belongs to us or our licensors and is protected by law. These Terms do not give you any right to use our names, logos or other trademarks. Apple, App Store, iPhone, iPad and Siri are trademarks of Apple Inc. Instagram is a trademark of Meta Platforms, Inc. Other trademarks belong to their owners. We are not affiliated with or endorsed by these companies.

9. Third-party services

When you share content to other apps or services, such as Instagram or Messages, their own terms and privacy policies apply. Purchases are provided by Apple under Apple's terms. We are not responsible for third-party services.

10. Disclaimer of warranties

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the App will be uninterrupted or error-free, or that it will produce any particular result for you.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of the App. Where our liability can be limited by law, our total liability to you is limited to the amount you paid for the App and Kiyolu Premium in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for intent or gross negligence, or for death or personal injury caused by negligence. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

12. Termination and changes to the App

Your licence ends automatically if you break these Terms. You can stop using the App at any time by deleting it; remember to cancel any subscription separately in your device's Settings. We may change, suspend or stop offering the App or any part of it. If we do, your mandatory consumer rights are not affected.

13. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the App. Apple is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws. If a third party claims that the App or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must follow any applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

14. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new "Last updated" date, and we will mention significant changes in the App's update notes. If you keep using the App after a change takes effect, you accept the updated Terms. If you do not agree, stop using the App and cancel any subscription.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. If you have a problem, please contact us first; most issues can be solved by email. Disputes are subject to the competent courts and enforcement offices of Türkiye. If you are a consumer, you may also bring a claim before the consumer arbitration committees or consumer courts where you live, and you keep the protection of any mandatory consumer laws of the country where you live.

16. General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right, we do not waive it. These Terms, together with our Privacy Policy and the Apple terms referred to above, are the entire agreement between you and us about the App. These Terms are available in several languages. If the versions differ, the English version prevails, unless the law of your country requires otherwise.
